BIFA Member Webinar – Failing to Prevent Fraud ECCTA 2023
All companies in the UK have a legal responsibility to prevent fraud, introduced as part of the Economic Crime and Corporate Transparency Act (2023). In this webinar for BIFA members, we will seek to simplify the legislation and and provide practical advice to ensure that you are not caught out.
BIFA will be joined by two lawyers from Birketts, a UK Top 50 law firm with a specialist transport and logistics team. Matthew Stratton, Partner, and Daniel Irving, Legal Director, have a wealth of experience handling legal issues and disputes in the sector and will provide practical insights into the application of this relatively new legislation.
The event will focus on:
- An overview of the legislation
- A brief overview of the offence
- Potential penalties
- The scope of the legislation
- The extra-territorial aspect of the legislation
- What will be regarded as a “reasonable defence”
Alongside the above, Matthew and Daniel will examine the circumstances in which companies not within the scope of the legislation, but who are supplying companies that are, may be required to comply with the new laws.
Contractual relations between forwarders and partners/agents can be complex, and for those Members within the scope of the legislation only by examining the precise content will it be possible to establish whether or not the ECCTA applies.
